Terms of Service

You must be at least 16 years old and capable of forming a binding contract to use the Service. By using Profaro, you represent and warrant that you meet these requirements.

Profaro is a SaaS platform that monitors Amazon seller storefronts and notifies you when new products are listed. We provide informational data only. We are not affiliated with, endorsed by, or in any way officially connected to Amazon.com, Inc.

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account.
• You may not share your account with others or create multiple accounts to circumvent plan limits.

• Access to the Service requires a paid subscription. Pricing is displayed on our pricing page.
• Subscriptions are billed monthly in advance and renew automatically unless cancelled.
• Payment is processed securely by Stripe. By subscribing you agree to Stripe's terms of service.
• We reserve the right to change pricing with at least 30 days' notice to existing subscribers.
• Failed payments may result in suspension of your account until the outstanding balance is settled.

If you are not satisfied with the Service, you may cancel within 7 days of your initial subscription date and receive a full refund, no questions asked. After 7 days, no refunds are issued for the current billing period, but you retain access until the end of that period. To request a refund, contact us at support@profaro.co.

You may cancel your subscription at any time through the billing settings in your account or by contacting support. Cancellation takes effect at the end of the current billing period. We do not prorate partial months except where required by the 7-day refund policy above.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract the underlying technology of the Service.
• Use the Service to harass, harm, or infringe the rights of others.
• Attempt to gain unauthorised access to our systems or to other users' accounts.
• Resell, sublicense, or redistribute the data or service without our written consent.
• Use automated tools to scrape or extract data from the Profaro interface beyond normal use.

All content, branding, software, and technology comprising the Service are owned by or licensed to Profaro and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your own internal business purposes. No other rights are granted.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to our data practices as described therein.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Fitness for a particular purpose or merchantability.
• Accuracy, completeness, or timeliness of Amazon data — Amazon may change their platform at any time.
• Uninterrupted or error-free availability of the Service.

To the maximum extent permitted by law, Profaro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service, including but not limited to loss of profits, data, or business opportunities. Our total aggregate liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless Profaro and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

We reserve the right to suspend or terminate your account at any time if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. We will refund any prepaid fees for unused periods on a pro-rata basis where termination is at our initiative without cause.

We may modify these Terms or the Service at any time. For material changes to these Terms, we will provide at least 14 days' notice by email or in-app notification. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts competent for the place of our registered business.
